Woodstock Rewards Terms and Conditions & Privacy Collection Statement
Rewards program
Solotel operates a rewards program (Rewards Program) for patrons of the Woodstock venue at Cnr Woodstock Avenue & Duke St, Rooty Hill NSW (Participating Venue). These terms and conditions apply to and govern our provision of the Rewards Program and your participation in the Rewards Program.
As part of your participation in the Rewards Program, Solotel and Woodstock will collect, use and disclose your personal information as set out in the Privacy Collection Statement below and our Privacy Policy located at https://solotel.com.au/privacy-policy. By participating in the Rewards Program you consent to such collection, use and disclosure of your personal information.
Membership of the Rewards Program is free and allows members of the Rewards Program to access certain benefits at the Woodstock Hotel. Currently, these benefits include but are not limited to:
- Members will be able to earn rewards points on eligible food and drink purchases at Participating Venues;
- Points can be redeemed for discounts on future purchases;
- From time to time, Participating Venues may offer bonus point promotions or exclusive member rewards; and
- Other offers or benefits we may provide from time to time.
Reward points will be credited to a Member’s account for qualifying purchases. Solotel and/or the Participating Venue will determine which purchases qualify for the Rewards Program and the number of points credited.
A Member must present their membership card (either physical or digital card) to the Participating Venue’s staff prior to the completion of a purchase. A failure to present the membership card results in no rewards points being credited to the Member.
The Participating Venue may (acting reasonably) deduct reward points from a Member if:
- The rewards points are credited in error;
- A refund is provided to the Member in respect of the transaction for which rewards points were credited; or
- The purchase for which rewards points were credited is cancelled.
Rewards points will not be credited until an individual becomes a Member of the Rewards Program. Members can check reward point balances via the online portal login or by asking a staff member. Any Member who has not used their Rewards card within 12 months will have their entire points balance expired. Any disputes regarding reward points should be notified to the Participating Venue at res.woodstock@solotel.com.au. Any tax, liability, or duty arising from a Member’s participation in the Rewards Program is the responsibility of the Member.
Membership
An individual may apply for membership of the Rewards Program by completing an online application at https://woodstock-hotel.com.au/.
We may add to, remove or otherwise change the benefits of the Rewards Program at any time, provided that we will use commercially reasonable efforts to provide you with reasonable notice of major changes to the benefits available as part of the Rewards Programs. Some benefits may be limited or subject to availability criteria, or where benefits are in the form of promotional offers, vouchers or similar, may be subject to additional terms and conditions (including expiry dates or availability periods as notified to you).
Solotel reserves the right to determine the eligibility criteria for participation in the Rewards Program. At all times, your access to these benefits and your eligibility to participate in the Rewards Program is subject to your compliance with these terms and conditions and you continuing to meet the following eligibility criteria:
- You are an individual and are over the age of 18 years old;
- You are not excluded from any Participating Venue or any other Solotel venue for any reason in accordance with any of our policies or procedures;
- You have provided Solotel with complete and accurate information to allow Solotel to administer the Rewards Program and undertake the matters set out in these terms and conditions;
- You are not a Member of the Rewards Program using any other name or contact details, as reasonably determined by us. If you have multiple Rewards Program accounts, we reserve the right to withhold any sign up or periodical benefits otherwise available to you for any of your Rewards Program accounts.
- You are not an employee of Solotel and/or any venues operated by Solotel.
These benefits are personal to you, and you must not use, or allow any third party to use, your Rewards Program card or membership for the benefit of another and you cannot transfer your membership benefits to a third party. You agree that a Solotel or Participating Venue representative may require you to produce photograph identification for the purpose of verifying your membership at the time of relevant transaction. Where you fail to produce satisfactory identification, Solotel may refuse to apply a membership benefit to a relevant transaction.
General
By signing up to this Rewards Program and presenting your Rewards card at the time of a transaction, you agree to be bound by these terms and conditions. We may vary these terms and conditions from time to time, provided that we will use commercially reasonable efforts to provide you with reasonable notice of major changes to these terms and conditions. If you do not agree to the varied terms and conditions, you can terminate your membership at any time in accordance with these terms and conditions.
A notice shall be deemed to be given by us if it is sent to the postal or email address of the member appearing in the Participating Venue’s database. You must notify Solotel of any changes to your personal details or if your membership card is lost or stolen.
It is your responsibility to protect your Rewards card and you must take reasonable precautions against any loss, damage or unauthorised use. Solotel is not responsible for delays in replacing a membership card or for any unauthorised use. A membership card remains the property of the Participating Venue and is non-transferrable and cannot be redeemed as cash.
Membership of this Rewards Program does not automatically give you a right of entry into a Participating Venue or any other venue owned or operated by Solotel, or right to enter into any transaction for food or beverages. Solotel reserves the right to refuse any person entry to its venues or relevant food or beverage transactions in accordance with its policies and applicable laws and regulations.
You must not provide false or misleading information to us and must not alter, reproduce, disclose or in any way interfere with the details of other members. Solotel reserves the right (acting reasonably) to disqualify, suspend or cancel any benefits obtained or accrued by any Member who does not comply with these terms and conditions.
We may set reasonable rules and policies regarding the Rewards Program and/or your participation in the Rewards Program and you must comply with all such rules that we notify you of.
Suspension and termination
Solotel reserves the right at its sole discretion to cancel, terminate, modify or suspend this Rewards Program, provided that Solotel will use reasonable commercial endeavours to notify you in advance before we cancel, terminate or materially change (in a way detrimental to Members) the Rewards Program.
If Solotel terminates the Rewards Program, Members will be able to redeem reward points during the notice period in accordance with these terms and conditions.
Solotel may (acting reasonably) terminate your membership and cancel rewards points immediately by providing you with written notice if:
- It becomes aware that you do not, or did not at any time during your membership, meet the eligibility criteria for the Rewards Program;
- It reasonably considers that you have used your membership fraudulently or otherwise in contravention of these terms and conditions or the law generally;
- It reasonably considers that you have abused any privilege associated with your membership;
- You have not used your Rewards card for a period of 12 months; or
- You notify us that you want to cancel your membership of the Rewards Program.
You can cancel your membership of the Rewards Program at any time by providing us with written notice (including by email to res.woodstock@solotel.com.au). Such termination will take effect within 14 days, or earlier once processed by us and notified to you. If your membership is terminated, you will not be able to receive or redeem the benefits, including any accrued benefits.
Liability
Subject to consumer guarantees set out in Division 1 of Part 3-2 of Schedule 2 of the Australian Consumer Law and to the extent otherwise permitted by law, Solotel:
- Accepts no responsibility and will not be liable to you for any issue or error which results in your inability to access the membership benefits; and
- Will not be liable for any damage whatsoever which is suffered (including but not limited to consequential loss) or for personal injury which is suffered or sustained, in connection with membership of this Rewards Program or with any of the Rewards Program offers or benefits, except for any liability which cannot be excluded by law.
General provisions
Where any provision of these terms and conditions is prohibited by law or judged by a court to be unlawful, void, or unenforceable, the provision shall, to the extent required, be severed from these terms and conditions and rendered ineffective as far as possible without modifying the remaining provisions of these terms and conditions, and shall not in any way affect any other circumstances of or the validity or enforcement of these terms and conditions.
Solotel reserves its right to waive in respect of any Member or Members (at our discretion) any right or requirement in these terms and conditions and/or the application of, or compliance with, any of these terms and conditions. Where Solotel exercises this waiver, this does not operate as a waiver of such right, requirement, application, or compliance if it arises again.
This document is governed by the laws of New South Wales. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and of any court that may hear appeals from any of those courts, for any proceedings in connection with these terms and conditions.
Definitions
- Australian Consumer Law has the meaning given in the Competition and Consumer Act 2010 (Cth)
- Member, you, your means the individual accepted by Solotel as a Member of the Rewards Program
- Participating Venue means a venue that is nominated by Solotel as participating in the Rewards Program.
- Solotel, we, us, our means Solotel Management Pty Limited ACN 613 396 179.
- Woodstock means The Trustee for Carousel Operations Unit Trust ABN 83 524 291 182
- You means any person who participates in the Rewards Program.
- Venues operated by Solotel means any Solotel entity that is outlined in Annexure A
Privacy collection statement
In operating this Rewards Program, Solotel and Woodstock will collect and handle your personal information. The use and disclosure of personal information generally by Solotel and Woodstock is governed by the Solotel Privacy Policy, available at https://solotel.com.au/privacy-policy.
For the purpose of this Rewards Program, Solotel and Woodstock may collect the following information at the time of receiving your membership request or administering the Rewards Program:
- Contact and identification information such as your name, date of birth, address, telephone number and email address;
- Information regarding your transactions with Solotel and Woodstock, including reservations and bookings you make, ordering history, food or beverage or other dining preferences, use of Rewards points or other benefits, attendance at any Participating Venue (regardless of whether you present your Rewards card at the time of a relevant transaction). This includes information about you from the point of sale, booking or other systems used at Participating Venues; and
- Any query, feedback or review that you submit to Solotel or Woodstock regarding your experience at any Participating Venue or in relation to this Rewards Program.
Solotel and Woodstock will generally collect this information from you, but may collect it from others from time to time, including the service providers or operators or managers of any Participating Venues. Solotel may also collect information about you from Woodstock and Woodstock may collect information about you from Solotel.
Solotel and Woodstock collect this personal information from you for the following purposes (Collection Purposes):
- To provide, administer, assess, customise and improve this Rewards Program and the hospitality services of Solotel and Woodstock;
- To provide you with promotional, marketing and other material related to Solotel, Woodstock and the Participating Venues, including promotions, offers or events and in relation to other venues owned or operated by Solotel and events that Solotel conducts or is involved in, including such promotional, marketing and other material targeted to you based on the information collected via the Rewards Program;
- To verify your identity and compliance with these terms and conditions;
- To respond to any queries or feedback you submit to Solotel or Woodstock; and
- To comply with any applicable laws or regulations applicable to this Rewards Program.
The promotional, marketing and other information that Solotel or Woodstock send may include promotional, advertising or other direct marketing materials or messages in relation to any Participating Venue, as well as other Solotel venues, events or services. These materials or messages may be sent using email, telephone, SMS, social media or other similar forms of communication. By providing your information to Solotel or Woodstock as part of the Rewards Program, you consent to Solotel or Woodstock sending such materials or messages. If you do not wish to receive these messages or materials, you can opt out at any time by contacting Solotel or Woodstock using the contact details set out below or through the opt-out mechanism contained in any communication to you.
Solotel or Woodstock may disclose your information to the entities set out in Annexure A of our privacy policy (located at https://solotel.com.au/privacy-policy) and to other parties for the purpose of operating and maintaining this Rewards Program, including service providers such as Zen Global Pty Ltd. Some of the parties that Solotel or Woodstock discloses your personal information to may be located outside Australia, including technology service providers located in Canada, the United States and the United Kingdom.
If you do not provide the personal information requested by Solotel or Woodstock or provide incomplete or inaccurate information, Solotel may be limited in how it can interact with you.
The privacy policy of Solotel sets out further details regarding how Solotel and Woodstock will collect, store, manage, use and disclose personal information it collects from you. The privacy policy also contains information about how you can access and seek correction of the personal information held by Solotel, how you can complain to Solotel about a breach of the Privacy Act 1988 (Cth) or any registered code under the Privacy Act that binds Solotel and how Solotel will respond to and deal with such a complaint.
